OpenHoops ("the app", "we", "us") shows basketball gyms and outdoor courts on a map and lets players check in so other players can see who is playing right now. These terms are the agreement between you and the owner of OpenHoops. By creating an account or using the app, you accept them. If you don't accept them, please don't use the app.

These terms work alongside our Privacy Policy, which explains what information the app handles.

Read this part first: you play at your own risk

OpenHoops helps you find real places and real people. That is the whole point of the app, and it is also the main risk of using it.

We do not know the people you will meet. We do not screen, verify, background-check, or vouch for any player, and a username tells you nothing about who someone actually is. We do not inspect courts or gyms, we do not control who else shows up, and we are not present at any run.

You decide whether to go somewhere and whether to play. That decision, and everything that follows from it, is yours. You accept the risks of meeting strangers in person, of travelling to and being at a court or gym, and of playing a contact sport — including injury, property damage, conflict with other people, and worse. To the fullest extent the law allows, you assume those risks and you agree that OpenHoops is not responsible for what happens between you and another player, or for anything that happens to you at a venue.

Practical advice, not legal text: meet in public, tell someone where you're going, trust your gut and leave if something feels wrong, warm up, know your own physical limits, and call local emergency services if someone is in danger — not us.

Who can use OpenHoops

You must be at least 13 years old to create an account or use OpenHoops. The app is not designed for, or directed at, children under 13, and we do not knowingly allow them to sign up. If we learn that an account belongs to someone under 13, we will close it and delete its data.

If you are under 18, you should use OpenHoops only with your parent's or guardian's permission, and you should talk to them about where you are going and who you are meeting. A parent or guardian who wants an account closed can write to us at support@tim-builds.dev.

You also need to be legally able to agree to these terms, and you must not be barred from using the app under the laws that apply to you.

Your account

You need an account to use OpenHoops. You agree to give accurate sign-up information, to keep your password to yourself, and to be responsible for everything that happens under your account. One person, one account — accounts are personal and may not be shared, sold, or transferred. Tell us at support@tim-builds.dev if you think someone else is using your account.

Acceptable use

OpenHoops only works if people can trust what they see in it. Don't do any of the following:

Harassment and abuse. No threatening, bullying, intimidating, hateful, sexual, or discriminatory behaviour toward another player — in the app or in person at a venue you found through it.
Stalking and surveillance. Don't use OpenHoops to monitor, follow, locate, or turn up on a specific person who does not want you there. Don't use it to build a picture of where someone goes or when. Don't use it to contact, watch, or track anyone who has blocked you, or anyone who has asked you to leave them alone. This is the conduct we take most seriously, and it will get an account removed without warning.
Impersonation. Don't pretend to be another player, a real person you are not, a venue, an official, or OpenHoops itself — including through your username, name, or profile picture.
Fake presence. Don't check in, announce that you are "heading there", or give thumbs-up for a court you are not actually at. Don't spoof, mock, or falsify your device's location, and don't use modified versions of the app or emulators to defeat the distance check. Don't create extra accounts to make a court look busier than it is, to inflate anyone's reputation, or to evade a block or a suspension.
Scraping and automated access. Don't scrape, crawl, harvest, bulk-download, or copy player data or venue data out of the app or its backend. Don't use bots, scripts, or any automated system to access the service, and don't access it other than through the official app. Don't reverse-engineer, decompile, or probe the app or our servers, don't try to get at data you were not meant to see, and don't test our security without written permission.
Interference. Don't overload, disrupt, or attack the service, and don't do anything that damages other players' experience of it.
Illegal use. Don't use OpenHoops to break the law, to organize anything illegal, or to trespass on private property. Venue listings are not permission to enter — access rules, hours, and fees are set by whoever runs the court or gym, and following them is your responsibility.

If someone's behaviour worries you, report or block them in the app (see below). If you believe someone is in immediate danger, contact your local emergency services — we are not an emergency service and cannot respond quickly.

Your content

The things you add to OpenHoops — your username, your optional first and last name, your profile picture, your check-ins, your "heading there" plans, and any other information you submit — are yours. You keep ownership of them.

By adding them, you give us permission to store, copy, and display them inside the app as needed to run the service (for example: showing your username and photo on a court roster to other players). That permission ends when you delete the content or your account, apart from copies that may sit in backups for a short time.

You promise that your content is yours to share — that you own your profile picture or have the right to use it, that it doesn't infringe anyone's rights, and that it doesn't contain anyone else's personal information. Don't upload anything sexual, violent, hateful, illegal, or misleading, and don't upload a photo of another person as your avatar.

We can remove content and close accounts. We may remove, change, or refuse any username, name, profile picture, check-in, or plan — and we may suspend or permanently close any account — if we believe it breaks these terms, harms another player, or exposes us to legal risk. We can do this at any time, with or without notice, and we are not obliged to give a reason. We also don't promise to review or monitor everything that gets posted.

Reporting and blocking

Every player has two tools, available from another player's profile in the app:

Block. Blocking hides you and the other player from each other on court rosters and player profiles, and stops thumbs-up between you.
Report. Reporting sends us the player, a category, and where it happened. Reports are private — the reported player is never told who reported them. We review reports and may warn, suspend, or remove an account.

We aim to look at reports promptly, but we are a small operation and we can't promise a response time, an outcome, or an explanation of what we decided. You can also write to support@tim-builds.dev, which is the right route if the person you want to report is no longer visible in the app.

Check-ins and location are not guarantees

Everything OpenHoops shows about who is where comes from other players' devices, and it can be wrong.

When you check in, the app compares your device's location to the venue's and only allows the check-in if you appear to be close enough. That is a rough check, not proof. Phone GPS drifts, especially indoors and in cities; venue coordinates in our directory may be inaccurate or out of date; a court may be closed, full, reserved, locked, or no longer exist; a person shown as "here" may have left without checking out; a "heading there" plan is an intention, not a commitment; and someone may simply be lying.

Treat rosters, counts, arrival times, and plans as hints, not facts. We don't verify that any player is actually at any venue, and we are not responsible for a wasted trip, a missed run, or anything else that follows from information in the app being wrong.

The app is provided "as is"

OpenHoops is free and is provided as is and as available, without warranties of any kind, whether express or implied — including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent the law allows.

We don't promise the app will be available, uninterrupted, secure, or error-free; that venue data or player data will be accurate or complete; or that any defect will be fixed. We may change, suspend, or discontinue any part of the app — or the whole app — at any time.

Some places do not allow certain warranties to be excluded. If that is true where you live, the exclusions above apply to you only as far as the law permits, and nothing here limits rights you have under applicable consumer protection law.

Limitation of liability

To the fullest extent permitted by law:

We are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of OpenHoops.
We are not liable for the conduct of any player, for anything that happens at a venue, for injuries sustained while travelling to or playing sport, or for any dispute between you and another person — whether it starts in the app or in person.
Our total liability to you for all claims relating to OpenHoops is limited to the greater of (a) the total amount you have paid us to use the app in the twelve months before the claim, or (b) CAD $50. The app is currently free, so in most cases (a) will be zero.

These limits apply even if we were told a problem was possible, and even if a limited remedy fails its essential purpose. They do not limit liability that cannot be limited by law, such as liability for our own fraud, or for death or personal injury caused by our negligence.

You agree to cover us for claims brought against us by someone else because of your use of OpenHoops, your content, or your breach of these terms.

Ending your account

You can stop using OpenHoops at any time, and you can delete your account three ways:

In the app: Profile → gear icon → Delete account. This permanently removes your profile, check-ins, thumbs-ups, plans, favorites, reports, blocks, and notification token.
Without the app: see our account-deletion page.
By email: write to support@tim-builds.dev from the address you signed up with.

Deletion is permanent — we can't restore an account or its history afterwards. See the Privacy Policy for what is removed and when.

We may suspend or terminate your account if you break these terms, if we believe you are putting other players at risk, or if we stop running the service. Where it's practical and safe to do so, we'll tell you why; in serious cases — harassment, stalking, threats — we may act immediately and without notice. The sections of these terms that should survive the end of your account (your content promises, assumption of risk, warranty disclaimers, liability limits, indemnity, and governing law) continue to apply.

Governing law

These terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You and we agree that the courts located in Ontario, Canada have exclusive jurisdiction over any dispute arising from these terms or from your use of OpenHoops — except that this does not remove any right you may have to bring a claim in the courts of the country where you live, or to rely on mandatory consumer protection rules there.

Changes to these terms

We may update these terms as the app changes. When we do, we'll update this page and the "Last updated" date at the top, and for meaningful changes we'll try to give notice in the app. Continuing to use OpenHoops after a change means the new terms apply to you. If you don't agree with a change, delete your account.

Other details

These terms and the Privacy Policy are the whole agreement between you and us about OpenHoops. If any part of them is found unenforceable, the rest still applies. If we don't enforce something right away, we haven't given up the right to enforce it later. You may not transfer your rights under these terms; we may transfer ours if the app changes hands. Nothing here makes you and us partners, employer and employee, or agents of each other.
